The customer agrees that use of the service(s) is entirely at customer's own risk. emailshot services are provided "as is", without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the service(s), including without limitation the results obtained through the service(s).

emailshot disclaims any and all warranties, including without limitation: 1) any warranties concerning the availability, accuracy or content of information, products or services and 2) any warranties of title or warranties of merchantability or fitness for a particular purpose.

This disclaimer of liability applies to any damages caused by any failure of performance, error, omission, interruption, deletion, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, negligence or under any other cause of action.

The customer specifically acknowledges that emailshot is not liable for the defamatory, offensive or illegal conduct of other customers or third parties.

Neither emailshot nor any of its agents, affiliates or content providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of the service or inability to gain access to or use the service or out of any breach of any warranty. The customer hereby acknowledges that the provisions of this section shall apply to all content on the service.

Anti-spam policy

The customer agrees to abide by our Anti-spam policy at all times, and understands that violating this may lead to immediate termination of service.

Collection and Use of Information by emailshot

Your personal information is used to create your personal access to products on the site, and to contact you in the course of using the products. Financial information that is collected is used to verify identity, and to bill either you or your company for products and services, as applicable. Under no circumstances will emailshot make any personal information about an individual user available to anyone outside of emailshot .

Contact Lists, Content and Reports

emailshot ensures that all contact lists, email content and reports remain private and confidential. emailshot may scan the content of your campaigns to ensure it complies with our Terms of Use - to protect against defamatory, inaccurate, abusive, obscene, profane, or threatening material that is racially or ethnically offensive.

emailshot will not sell, rent, loan or invite external access to a customer's contact lists. Nor will emailshot themselves use customer's contact lists for any purpose.

By default emailshot will clean contact lists of persistently bouncing email addresses but if required, these settings can be over ridden and changed.

Payment

emailshot will bill monthly based on the monthly email totals that have been sent in the preceding month.

Cancellation

If you wish to cancel your account, you must inform us in writing and allow 28 days for the account to become inactive.
